When using Notyfile's online services, the following general conditions apply. Valid from 2021-03-08.
1. Background
Notyfile is a service for companies that collects customer information application-based tool. The information posted is collected under the respective login. Through this tool, you as a user get access and a consolidated view of everything that concerns your customer in various so-called modules. These modules include contract management, prospecting tools, quotation tools, meetings, dialers, dashboards, etc
2. General and definitions
These General Terms and Conditions applies between Note file and such natural person / company who use The service. By using the Service you agree The user these General Terms and Conditions and also declares that he has read the information presented. If the User does not agree to the terms and conditions in these General Terms and Conditions, the User is asked not to use the Service.
"Terms and Conditions"
These general conditions.
"The User"
The natural person / company that uses the Service.
"User account"
The personal account that the User registers in the application in order to use the Service.
"The Application"
app.notyfile.se, the web-based platform from which the Service is provided and from which the Service is accessible to the User.
"Login details"
The username and password that the User is assigned in connection with the registration of their User account.
"The Service"
The service provided by Notyfile to the User via the Application.
"Third Party Websites"
Websites that belong to third parties and are referred to on the Website.
3. Change of Terms
Notyfile reserves the right to change or add to these General Terms and Conditions at any time. Any changes come into effect no later than seven (7) days after (i) the User is sent written notice of the change, (ii) the change is published on the Website or (iii) the User otherwise becomes aware of the change. If the Service is used after these seven (7) days have expired, the User is deemed to have accepted the new terms.
4. Registration of User Account
The use of the Service requires that the User has registered a User Account on the Website or via the Application and accepted these General Terms and Conditions. When the User registers a User Account, Notyfile is given the opportunity to obtain information about the User from third parties such as banks or public records. This information may include personal data and is processed in accordance with PuL and in accordance with what appears in clauses 5 and 16 of these terms and conditions. The user account is personal and may only be used by the user personally, thus it is not permitted to be multiple users on the same user account. The request to sign up or terminate a service is legally linked to the social security number specified in the User Account. When registering, it is required that the User provides correct, current and complete information that the registration requires, especially social security number and a valid e-mail address. The user is obliged to keep the current information in his user account updated and correct, and in the event of a change, to correct the information without delay. The user account cannot be transferred or inherited. When registering, the User enters their personal Login details. The login details can be changed at any time by the User. The User is responsible for the User Account being used only by the User himself, and is therefore obliged to keep Login Details secret and without access to unauthorized persons. The User must immediately notify Notyfile in case any unauthorized person has come across such information that the User is obliged to keep protected in accordance with this provision. The user account is active until the day when 1. The user unregisters as a user, 2. Notyfile suspends the user from the service or 3. When the service is shut down by notyfile
5. Privacy, confidentiality and data management
Notyfile saves data to the extent that it is necessary for the User to use the service's current and future functions. This data includes, in addition to personal data, information obtained from third parties and/or information manually entered by the User in the service. Notyfile can retrieve information from external registers to facilitate the use of the service, for example civil registration address. The User can at any time request that Notyfile stops saving data and deletes the data saved about the User's User Account. The request for this must be made in writing according to the directives in point 20. Notyfile never sells or shares personal data saved by the User using the Service. Notyfile promises that data exposed to third parties is always aggregated and anonymized. Handling of personal data is clarified in point 16.
6. The Service
The service is accessible to the User via Website and Applications. The service is web-based and traffic charges may therefore be added to the User's data provider. SMS traffic is charged in addition to the price for the e-signature packages. price per SMS is SEK 0,8 excluding VAT.
Notyfile has the right to implement updates and new versions of the Service to the extent that Notyfile deems appropriate. Notyfile further has the right, without prior notice, to implement changes, of whatever kind, in the Service or the manner in which the Service is provided. The service may include offers from Notyfile or the company's partners. If the User accepts an offer from a third party, the third party's terms and conditions apply. It is the User's responsibility to understand what external conditions include. Notyfile is responsible for ensuring that any offers are not perceived as offensive and meet the company's guidelines.
7. Use of the Service
By using the Service and accepting these General Terms and Conditions, the User obtains a non-exclusive right to access and use the Service in accordance with these General Terms and Conditions. The user must also follow the instructions provided by Notyfile for the use of the Service. The User guarantees that the User will not use the Service for purposes that are contrary to current legislation or these General Terms and Conditions. The user is responsible for all activity that takes place within the framework of his user account. This therefore also applies to activity that takes place without authorization. If the user suspects abuse by unauthorized persons, they must immediately report this to Notyfile. Notyfile shall then without delay block the User account from further use. The user must follow the security regulations that Notyfile has specified in the Service at any time. Notyfile reserves the right to change applicable security regulations. Such changes enter into force in connection with their publication on the Website. In case of misuse of the Service, the User is obliged to compensate Notyfile for the damage incurred in connection with the misuse. The User must further compensate Notyfile for the damage that occurs due to the User using the Service in violation of these General Terms and Conditions.
8. Limited access to the Service
Notyfile does not guarantee any continuous, uninterrupted or secure access to the Service. The Service may be disrupted by factors beyond Notyfile's control, and Notyfile therefore does not provide any guarantees for the Service's function or availability. Notyfile has the right to take measures that affect access to the Service if this is necessary for technical, maintenance or security reasons. In cases where the use of the Service seriously damages or risks seriously damaging Notyfile, Notyfile also has the right to immediately shut down access to the Service. Users must be informed as soon as possible that access to the Service has been suspended or restricted in some respect. Notyfile has the right to suspend the User from the Service at any time if the User is suspected of violating these General Terms and Conditions or otherwise causing damage to Notyfile, Service Provider, organization, other user or other person. Notyfile decides on its own whether Users can be assumed to have violated any provision of these General Terms and Conditions.
9. Intellectual Property Rights
Notyfile owns all rights, including intellectual property rights to the Service, including but not limited to process, method, software and design. The user receives no intellectual property rights to the Service or any of the material created in the Service. This means, among other things, that Notyfile remains the owner of all its intellectual property rights and characteristics such as copyright, design protection, trademarks and other registered and unregistered rights. Nothing in these General Terms and Conditions shall be interpreted as ceding any of these rights in whole or in part to the User. The user does not have the right to copy, reproduce, sell, license, distribute, modify, decompile or otherwise make changes to the Service, nor make the Service, or parts of the Service, available to others. All content on the Website such as texts, graphics, logos, buttons, icons, audio files and software belong to Notyfile or the provider of the content, for example Service Providers or organizations. Any unauthorized use or distribution of the content on the Website that risks violating applicable legislation or these General Terms and Conditions may be subject to legal action.
10. Third Party Websites
The website and applications may contain links to third-party websites. Third-party websites are outside Notyfile's control and responsibility. Notyfile is not responsible for the content of Third Party websites and is also not responsible for any damage that occurs in connection with the use of the services found on Third Party websites. Notyfile urges the User and visitors to the Website who click on links to Third Party websites to review the terms and conditions and privacy policies of these Third Party websites.
11. Cookies
A cookie is a passive text file that is stored by the browser on the User's computer or other device when connecting to the Website. Notyfile uses cookies to facilitate the User's use of the Service and to collect information such as statistics on the User's or other users' use of the Service. The user approves the use of cookies. The user also has the option of denying the receipt of cookies in their browser, which may negatively affect the functionality of the Service.
12. Handling of personal data
Notyfile is, where nothing else is specifically stated, responsible for personal data in accordance with the Personal Data Act (1998:204) for the processing of such information provided by the User to Notyfile or obtained by Notyfile from Service Providers or organizations, for example name, social security number, address information and information about the User's agreement with service providers or organizations. Personal data is processed by Notyfile solely for the purpose of being able to provide the Service. By using the Service, the user consents to the processing of personal data for such purpose. Users also agree through the use of the Service that personal data may be disclosed by Notyfile to Service Providers or organizations in order for Notyfile to be able to fulfill the User's request for purchase, order or termination of agreements and/or membership with Service Providers or organizations. The User has the right to find out once a year what information about the User has been processed by Notyfile by contacting Notyfile at the contact details specified in point 16. The User also has the right to withdraw consent to the processing of personal data. However, a cessation of such processing may mean that Notyfile cannot continue to provide the Service to the User or enter into and/or terminate agreements and/or membership with Service Providers or organizations on behalf of the User. Notification of a withdrawal of consent must be submitted in writing to one of the addresses specified in point 20. With regard to such information that the User, within the framework of the use of the Service, provides to the Service Provider/organization, the Service Provider/organization is responsible as the personal data controller for the processing of the User's personal data takes place in accordance with applicable legislation.
13. Limitation of liability and disclaimer
Notyfile takes no responsibility for the activity that takes place in the Service nor such information that is available to the User in the Service. Notyfile is therefore never obliged to pay compensation for, among other things, but not exclusively; loss of income, loss of data or other direct or indirect damages and costs of whatever kind that may be directly or indirectly due to the User's or other users' use of the Service, the material found in the Service or the interactions that take place between the User and the Service Provider/organization. The limitation of liability thus also applies to the User's possible compensation obligation towards third parties. Notyfile's liability for damages shall, unless there is intent or gross negligence, be limited to three (3) times the price base amount applicable at the time of the occurrence of the damage according to Chapter 2 § 7 of the Social Security Code. In order to be valid, the user's request for compensation must be submitted within a reasonable period of time after the damage was discovered or should have been discovered. A reasonable time shall normally be considered to be thirty (30) days.
14. Claims from third parties
If a third party were to make a claim against Notyfile due to the User's use of the Service, the User undertakes to compensate Notyfile for all costs that Notyfile incurs due to such a claim. Notyfile must notify the User within a reasonable time from the time the claim was made. Notification must be made in writing.
15. force majeure
With the exception of cases where the party has acted with gross negligence, the party is always released from liability for breaches of the agreement caused by events beyond the party's control, such as lightning strikes, fires, power outages, strikes, war, mobilization or military conscription of a larger scale, requisition, seizure, authority regulations, authority action, newly added or amended legislation, conflict on the labor market and thereby equal circumstances.

The user accepts that all communication from Notyfile, including but not limited to messages and other information regarding the Service and/or these General Terms and Conditions may take place electronically. 17. Notices
Notices to the other party must be delivered by courier, registered letter or e-mail to the addresses most recently provided by the other party. Notice shall be deemed to have reached the other party if it is 1. delivered by courier, upon delivery, 2. sent by registered mail, five (5) days after dispatch, or 3. sent by e-mail, on the day of dispatch.
18. Invalidity of provision
Should any provision, or part thereof, in these General Terms and Conditions be deemed invalid, this shall not mean that the agreement in its entirety is invalid. Instead, reasonable adjustment of the agreement must take place to the extent that the invalidity significantly affects the parties' exchange or performance according to the agreement.
19. Termination
To terminate the service, official notice must be received via e-mail, or alternatively by letter. The notice period is 3 months.
20. Assignment
A party does not have the right to fully or partially pledge or transfer rights and/or obligations under the agreement to another without the other party's written approval. Regardless of what is stipulated in the preceding sentences, Notyfile always has the right to assign the agreement to a company in relation to which Notyfile is in a group relationship.
21. Applicable Law and Dispute Resolution
Swedish law shall be applied to the agreement between the User and Notyfile, where applicable these General Terms and Conditions. Disputes that arise between the User and Notyfile must be settled in a general court.
22. Third parties and transfer of data
Even before GDPR became known, we worked hard on data security and data management. We have a clear structure for how this is handled and clear documentation.
All data is stored on Google Cloud Platform (GCP), which in turn complies with the requirements in Europe.
Notyfile uses and transmits information received from Google APIs to other app and follows Google API Services User Policy, including the limited use requirements.
